Terms of Service for Structural & Code Consultation Service
1. Scope of Work
This agreement covers the services explicitly stated in the purchased consultation package. Any additional services, revisions, or work beyond the original scope will require a separate agreement and may be subject to additional fees.
2. Client Responsibilities
Clients must provide all necessary documentation, including permits, site plans, and project information before work begins. Failure to provide requested information may delay the delivery of services and does not exempt payment obligations.
3. Revisions and Additional Work
The service includes one round of revisions to address client feedback or minor changes. Additional revisions, scope changes, or requests for details not outlined in the original agreement will be billed at the hourly rate specified in the proposal or client agreement.
4. Payment Terms
Payment is required in full before services commence. Payments are non-refundable once work has started, regardless of project outcomes or delays caused by third parties (e.g., city reviews, permit approvals, or client inaction).
5. No Guarantee of City Approval
While every effort is made to ensure compliance with local building codes, we cannot guarantee city or municipal approval of drawings or details. Any additional work required to satisfy city requirements beyond the agreed scope will be billed at the applicable hourly rate due in advance.
6. Site Visit and Documentation
If a site visit is included in the service, it will be conducted at a mutually agreed-upon time. Any additional site visits beyond what is stated in the agreement will incur additional charges.
7. Project Timelines
Estimated delivery timelines are provided as a courtesy and are subject to change based on project complexity, client responsiveness, and external factors. Delays caused by the client’s failure to provide necessary information do not alter payment terms.
8. Termination of Services
We reserve the right to terminate services if:
The client is unresponsive for more than 10 business days.
Additional work requests exceed the agreed-upon scope without additional compensation.
The client fails to comply with payment terms.
9. Liability and Warranty
Our services are limited to providing professional expertise and documentation as agreed. We are not liable for construction defects, delays, or non-compliance caused by contractors or other third parties.
10. Ownership of Deliverables
All deliverables, including drawings, plans, and documents, remain the intellectual property of Turnwood Design Group LC until full payment is received. Once paid, the client is granted a non-exclusive license for project use. Deliverables cannot be resold, distributed, or used for other projects without written consent.
11. Communication
All communications must be conducted in writing (via email) to ensure clarity and accuracy. Phone calls or verbal agreements will not override written terms unless formally documented.
12. Dispute Resolution
In the event of a dispute, both parties agree to attempt resolution through mediation before pursuing legal action. Any legal disputes shall be governed by the laws of the State of Michigan.
13. Acceptance of Terms
By purchasing our Structural & Code Consultation Service, the client agrees to these Terms of Service.
