Welcome to Turnwood Design Group LC (“Company”, “we”, “our”, or “us”). These Terms and Conditions (“Terms”) govern your use of our website [turnwoodgroup.com] and your purchase or participation in any of our design consultations, digital services, or related products (collectively, the “Services”).

By accessing our website or engaging our Services, you (“Client”, “you”, “owner” or “your”) agree to be bound by these Terms and our Privacy Policy. Please read them carefully before proceeding. If you do not agree with these Terms, you may not use our Services.


1. Scope of Services

Turnwood Design Group LC provides professional architectural design, feasibility, visualization, and consulting services related to residential renovations, remodels, and additions. These services may include, but are not limited to:

  • Feasibility studies and home analyses

  • As-built documentation and 3D modeling

  • Conceptual and schematic design

  • Design development and visualization packages

  • Preparation of construction documents

  • Consultation services such as the Home Revival Blueprint™, Classical House Transformation Strategy, and related digital products.

Each project’s scope, deliverables, and investment schedule are defined in a written proposal or agreement provided to you before work begins.


2. Digital Services and Products

All digital consultations, downloadable guides, reports, or documents—including but not limited to the Home Revival Blueprint™, Renovation Priority Playbook, and related digital materials—are considered digital goods.

  • Delivery: Digital products and reports are delivered electronically to the email address you provide.

  • Usage: These products are for personal, non-commercial use only. You may not copy, share, resell, or distribute them in any format without prior written consent.

  • No Refunds: Because digital materials and consultations deliver immediate intellectual property and professional insight, all sales are final. Once purchased, no refunds, exchanges, or chargebacks will be issued under any circumstances.

  • Results Disclaimer: While we strive to provide accurate and actionable information, success depends on individual implementation and external conditions. We make no guarantee of financial return, construction cost, or resale value based on our digital content.


3. Design Service Agreements

Custom design services (including schematic design, design development, and construction documentation) are governed by a separate written proposal and agreement.

  • You will receive a detailed scope of work, timeline, and deliverables prior to entering the agreement.

  • Design services are performed in sequential phases—each phase builds upon the prior one.

  • Each phase requires partial payment upon completion or commencement, as outlined in your proposal:

    • 35% retainer upon signing

    • 25% at Schematic Design delivery

    • 15% at start of Construction Documents

    • 25% upon final delivery of Construction DocumentsDesign Project Roadmap 3.0.

  • Additional services (such as contractor selection or construction observation) are optional and billed hourly unless otherwise stated.

No work will begin without written approval and receipt of the required deposit or retainer.


4. Construction Document Services

Preparation of construction documents represents a separate and more advanced service.

  • Construction drawings are not legal building permits and may require approval by your local building department and licensed professionals (engineers, surveyors, etc.).

  • Turnwood Design Group LC does not act as Engineer of Record or General Contractor and assumes no responsibility for construction means, methods, or on-site safety.

  • The Client is solely responsible for hiring qualified contractors and obtaining all required permits.

  • Additional terms, limitations of liability, and professional disclaimers will be detailed in a supplemental Construction Document Agreement, which governs that phase of work.


5. Payment Terms

Payment for all custom design services are structured in phased milestones, as outlined in the Design Project Roadmap:

All payments are non-refundable.
Payments must be received prior to the release of digital deliverables associated with each phase.

Late payments beyond 14 calendar days may incur an interest charge of 1.5% per month (18% per annum) or the maximum allowed by Michigan law, whichever is lower.

Invoices are due upon receipt unless otherwise specified in the proposal.

  • Late payments beyond 10 days may incur a 3% monthly service charge or the maximum allowed by law.

  • Failure to pay may result in suspension of services, withholding of deliverables, or termination of the agreement.

  • Returned checks or chargebacks will incur an additional administrative fee of $50 per incident.

All fees are non-refundable. Payments made toward project phases are considered earned upon commencement of that phase.


6. Ownership and Intellectual Property

All sketches, plans, drawings, models, digital materials, and other creative works produced by Turnwood Design Group LC remain the intellectual property of the Designer until full payment is received.

Upon full payment:

  • The Client receives a non-exclusive license to use the design drawings for the specific property and project described in the proposal.

  • Reuse or modification of drawings for other projects or properties is strictly prohibited without prior written consent and additional compensation.

  • The Designer retains the right to:

    • Reproduce and publish designs for marketing, portfolio, and educational purposes (with personal addresses omitted).

    • Display work on websites, social media, and promotional materials.


7. Client/ Responsibilities

You agree to:

  • Provide accurate information and timely feedback.

  • Approve or request modifications within reasonable timeframes.

  • Obtain necessary permits and engage qualified contractors.

  • Comply with all applicable building codes, HOA guidelines, and ordinances.

The Designer’s ability to deliver on schedule depends on your responsiveness and cooperation.


8. Limitation of Liability

Turnwood Design Group LC and its representatives shall not be liable for:

  • Construction defects, cost overruns, or delays caused by contractors or third parties.

  • Errors or omissions arising from inaccurate information provided by the Client.

  • Incidental or consequential damages, including loss of profit, use, or data.

  • Any claim exceeding the total fees paid by the Client for the specific service giving rise to the claim.

Design services are advisory and illustrative. The Designer’s responsibility ends upon delivery of contracted materials.


9. Cancellation & Termination

Either party may terminate the engagement with written notice.

  • If terminated by the Client before project completion, the Designer will invoice for work performed and expenses incurred up to that point.

  • No refunds will be provided for completed digital consultations, reports, or design phases already initiated.

  • If terminated by the Designer due to Client noncompliance or nonpayment, all fees due immediately become payable.


10. Confidentiality & Data Protection

All information you provide is treated as confidential and used solely for the purpose of your project.
We may use anonymized project data or design imagery for educational or marketing purposes. Personal addresses, financial data, and identifying details will remain private.


11. Force Majeure

We are not liable for delays or failure to perform due to causes beyond our reasonable control, including natural disasters, government actions, labor strikes, power outages, pandemics, or supply-chain interruptions.


12. Indemnification

You agree to indemnify, defend, and hold harmless Turnwood Design Group LC, its members, employees, contractors, and agents from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorney’s fees) arising out of or relating to:

  • Your use of the Services, Deliverables, or Digital Products;

  • Any construction, renovation, or other activity performed by you or your contractor in reliance on our drawings or advice;

  • Your failure to obtain required permits, approvals, or engineering reviews; or

  • Your breach of these Terms or misuse of the Deliverables.

This obligation survives termination or completion of the Services.


13. No Warranty

All Services, consultations, and Deliverables are provided “AS IS” and “AS AVAILABLE.”
Turnwood Design Group LC makes no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
Because design and construction inherently involve judgment and variables beyond our control, we cannot and do not guarantee any specific outcome, resale value, permit approval, or construction cost.


14. Client Delays and Changes in Scope

The project schedule assumes timely responses and decisions from you.
If you fail to provide information, feedback, or approvals within agreed timeframes, Turnwood Design Group LC may suspend Services until responses are received and may adjust deadlines or fees accordingly.
Any change in the project scope, budget, or requested deliverables after written approval of a phase will require a written change authorization and may incur additional fees at the current hourly rate.


15. Assignment and Subcontracting

Turnwood Design Group LC may, at its discretion, engage qualified subcontractors, consultants, or affiliates to perform portions of the Services while remaining responsible for quality and coordination.
You may not assign or transfer any rights or obligations under these Terms or any related agreement without our prior written consent.


16. Insurance and Contractor Responsibility

Turnwood Design Group LC does not provide or maintain any insurance for your construction activities and is not responsible for on-site safety, workmanship, or contractor performance.
You are solely responsible for hiring properly licensed and insured contractors and verifying compliance with building codes, ordinances, and permit requirements.


17. Severability and Waiver

If any provision of these Terms is found invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary so the remaining Terms remain in full force and effect.
Failure by either party to enforce any provision shall not be considered a waiver of the right to enforce that provision in the future.


18. Entire Agreement and Amendments

These Terms, together with any signed proposal, service agreement, or supplemental addendum, constitute the entire agreement between you and Turnwood Design Group LC and supersede all prior discussions or communications.
No amendment or modification is valid unless in writing and signed by both parties (digital signatures accepted).


19. Limitation of Claims

Any claim or cause of action arising out of or related to the Services must be made within twelve (12) months after the date final deliverables are provided; otherwise, the claim is permanently barred.
In no event shall our total liability exceed the amount of fees actually paid by you for the specific service giving rise to the claim.


20. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or related to the Services, Deliverables, or interpretation of this Agreement shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict-of-law rules.

Both parties agree that:

  • The exclusive venue for any action or proceeding shall be the state or federal courts located in Oakland County, Michigan.

  • Each party hereby consents to the personal jurisdiction of those courts and waives any objection based on improper venue or forum non conveniens.

  • Before filing suit, the parties will make a good-faith effort to resolve disputes through informal discussion or voluntary mediation.

You agree that any cause of action must be brought individually and not as part of a class or representative action.


21. Updates to Terms

We reserve the right to update or modify these Terms & Conditions at any time. Updated terms will be posted on our website with the revised date indicated. Continued use of our services constitutes acceptance of the updated terms.
