TERMS & CONDITIONS
Commercial Facility Feasibility & Code Strategy Session
1. Nature of Service
This service is a pre-design advisory and strategy consultation intended to evaluate feasibility, code considerations, and planning direction for a proposed commercial project.
No construction drawings, permit documents, or engineered plans are included in this service.
All recommendations provided are conceptual and strategic in nature and are intended to guide decision-making prior to engaging full design and engineering services.
2. Independent Consortium Structure
This service is delivered through a collaborative consortium of independent professionals, which may include:
Design consultants
Code and planning specialists
Engineering consultants (if applicable)
Each participating party operates as an independent business entity and is not an employee, partner, or legal agent of the other.
No joint venture, partnership, or single legal entity is created by this collaboration.
Any future agreements for design, engineering, or construction services will be contracted separately with the appropriate party.
3. No Guarantee of Approval
While the consultation is designed to identify the most viable path forward, no guarantee is made that:
The proposed use will be approved by the municipality
Permits will be issued
Specific interpretations by city officials will align with recommendations
Municipal review authorities maintain final discretion over all approvals.
4. Advisory Scope Only
This service does not include:
Sealed architectural or engineering drawings
Final code compliance certification
Permit submission or representation
Construction administration or site supervision
All findings are based on available information, existing conditions, and professional judgment at the time of review.
5. Client Responsibility
The client is responsible for:
Providing accurate and complete information (including drawings, measurements, and intended use)
Verifying all final requirements with the appropriate authorities having jurisdiction
Retaining licensed professionals for permit drawings, engineering, and construction
6. Limitation of Liability
To the fullest extent permitted by law:
This service is provided for advisory purposes only
The consultant(s) shall not be liable for any direct, indirect, or consequential damages arising from decisions made based on this consultation
No responsibility is assumed for construction outcomes, contractor performance, or municipal decisions
7. Payment & Refund Policy
Payment is required in full prior to scheduling the consultation
Due to the preparatory analysis involved, all fees are non-refundable once work has commenced
Rescheduling may be accommodated with reasonable notice, subject to availability
8. Future Services
If the client elects to proceed with design or documentation services:
A separate agreement will be provided outlining scope, fees, and responsibilities
Any applicable credit from this consultation will be defined in that agreement
9. Acceptance of Terms
By purchasing this service, the client acknowledges and agrees to these Terms & Conditions in full.
